1. Eligibility and Account Security
 

• Age Requirement: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to create an account or purchase services.

• Single-User Access: Accounts are individual and non-transferable. You agree not to share your login credentials, passwords, or course materials with any third party. Simultaneous logins from distinct geographic locations or shared credential abuse will result in immediate termination without refund.

• Account Accuracy: You must provide accurate, current, and complete information during registration and keep your account details updated.
   

2. Physical Activity & Medical Disclaimer
 

• Voluntary Participation: Dancing—including Bachata Sensual, Traditional Dominican Bachata, body isolations, partnering mechanics, and footwork drills—involves physical exertion, balance, and movement. By using this Platform, you acknowledge that dance training carries inherent risks of physical strain, muscle tears, sprains, falls, or other injuries.

• Health Clearance: You are responsible for assessing your physical fitness before performing any exercise or dance routine demonstrated on the Platform. We advise consulting a licensed physician before beginning any new physical regimen.

• Assumption of Risk: You voluntarily assume full responsibility for any physical injuries, damages, or losses sustained while practicing our lessons at home, in studios, or on social dance floors. Ganga Melka LLC, its founders, and instructors accept zero liability for injuries resulting from your participation.
   

3. Membership Tiers & Billing Terms
 

• Free Membership ($0): Grants access to select introductory lessons (8 foundational lessons) and community features. No credit card is required. We reserve the right to modify or revoke free access tiers at our discretion.

• Premium Membership ($29 / Month):

  • Billing Cycle: Billed automatically on a recurring 30-day cycle to your payment method on file until cancelled.

  • Content Delivery: Unlocks initial foundational content (60 video lessons) followed by monthly content drip releases (16 lessons per month; 4 per style) as described in the curriculum schedule.

  • Included Services: Includes access to practical level exams, up to 4 personalized video critiques (up to 5 minutes each), completion certificates, and two milestone-based virtual private lessons (one 20-minute check-in, one 30-minute deep dive).

• VIP Annual Membership ($290 / Year):

  • Billing Cycle: Billed automatically once per year on the anniversary of signup until cancelled.

  • Content Delivery: Immediate, full access to the complete 240+ video lesson catalog, priority exam grading, immediate access to schedule virtual private sessions, and early access to the advanced Elite Vault upon official release.

• Payment Processing: All payments are processed securely through our third-party merchant processor (Stripe). You authorize recurring charges using the billing details provided.
   

4. Cancellation & Refund Policy
 

• Subscription Cancellations: You may cancel your monthly or annual subscription at any time directly through your student billing portal or by emailing info@gangamelka.com at least 48 hours before your next billing renewal date.

• Access Upon Cancellation: Upon cancellation, you retain full platform access until the end of your paid billing period. No further renewals will be processed.

• Refund Policy:

  • Monthly Subscriptions ($29/mo): Monthly subscription payments are strictly non-refundable once billed. We do not provide prorated refunds for mid-cycle cancellations.

  • Annual VIP Subscriptions ($290 / Year): Due to the immediate delivery of and instant, unrestricted access to the complete library of 240+ proprietary video lessons, priority exam grading, and immediate coaching booking privileges upon enrollment, all purchases of the Annual VIP Subscription are strictly final and 100% non-refundable. Ganga Melka LLC does not offer refunds, trial periods, returns, or prorated credits for annual plans under any circumstances. You may cancel the automatic renewal of your annual pass at any time before your next billing date to prevent future recurring charges, and your access will remain active until the end of your paid annual term.
     

5. Video Exam Submissions & 1-on-1 Coaching
 

• Student Video Submissions: You retain personal ownership of videos you record and upload for exam review. By submitting exam videos, you grant Ganga Melka LLC a non-exclusive, private license to view, review, and mark up your footage for educational assessment. We will never publish or publicly share your student exam footage without your express written consent.

• Virtual Private Lessons:

  • Milestone-unlocked and private coaching sessions must be scheduled through our designated calendar tool.

  • Rescheduling / No-Show Policy: You must provide at least 24 hours' notice to reschedule a booked private coaching session. Missing a session without 24 hours' notice results in forfeiture of that coaching session.

  • Private lessons must be utilized within active subscription periods and hold no independent cash value.
     

6. Intellectual Property Rights

All materials on the Platform—including video footage, instructional systems, dual-angle recordings, curriculum structures, text, graphics, logos, choreography, audio clips, and course materials—are the proprietary intellectual property of Ganga Melka LLC.

• Permitted Use: You are granted a personal, limited, non-exclusive, revocable, and non-transferable license to stream instructional videos for personal, non-commercial education.

• Prohibited Conduct: You may not copy, record, screen-capture, download, reverse-engineer, redistribute, sell, publicly display, or teach our proprietary choreography or system as your own without prior written authorization from Ganga Melka LLC. Violations will result in legal prosecution under US copyright laws.
   

7. Limitation of Liability

To the maximum extent permitted by applicable law, Ganga Melka LLC, its directors, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including personal injury, property damage, loss of data, loss of profits, or dance floor altercations—resulting from your access to or inability to access the Platform. Our maximum aggregate liability shall not exceed the total amount paid by you to Ganga Melka LLC during the six (6) months immediately preceding the event giving rise to the claim.

8. Governing Law & Jurisdiction

These Terms and any disputes arising out of your relationship with Ganga Melka LLC shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to conflict of law principles. Any legal proceeding shall be filed exclusively in state or federal courts located in Wyoming, USA.
